Our Terms

1. Description of Service

ARA Ai Solution ("ARA", "we") provides AI assistants and automation for businesses, including:

The ARA WhatsApp Assistant (reminders, tasks, notes and contextual memory)
ARA Telegram assistants, including the Receipt Assistant and demonstration bots
AI Avatar and content services, including MunculPro
Custom workflow automation

ARA is not a human. Responses and extracted figures are generated by AI and may not always be correct.

2. Acceptance of Terms

By starting a chat with an ARA assistant (for example sending /start or your first message), or by using any ARA service, you confirm that:

You have read these Terms and our Privacy Policy
You accept and agree to them

Continued use after an update means you accept the updated Terms.

3. Business Clients and White-Label Assistants

Where ARA builds or runs an assistant for a business client under that client's name:

The signed quotation, scope or agreement with that client governs fees, delivery, service levels and data processing, and prevails over these Terms if they conflict
The business client is responsible for its own terms and privacy notice to its users, and for having a lawful basis to share its users' data with us
ARA processes that data only on the client's instructions

4. User Responsibilities

You agree not to:

Use the services for illegal, fraudulent or harmful activity
Upload malware, impersonate anyone, or share content you have no right to share
Send sensitive information the service does not need
Abuse, overload or attempt to access our servers, databases or other users' data
Resell or share access to a service without our written agreement

You are responsible for verifying important decisions and figures before relying on them.

5. Receipts and Records

The Receipt Assistant reads and organises documents. It is not accounting, tax or legal advice.
Extracted figures must be confirmed by you (or the firm you deal with) before they are used in any accounts or tax filing.
You remain responsible for your own record-keeping obligations under Malaysian law, including keeping original documents.

6. AI Avatars and Content

You confirm you have the right to use every face, voice, name and material you provide, and you grant ARA the licence needed to create your content with it.
Your likeness is used only for content you approve, and never for anyone else.
Ownership of finished content passes to you once it is paid in full, unless your agreement states otherwise.
We will not create content that is deceptive, defamatory, or impersonates anyone without their consent.

7. Fees and Payment

Fees are as set out in your quotation, scope document or agreement, or on the relevant sales page (for example munculpro.com). Unless your agreement states otherwise:

Fees are payable in advance, and late payment may pause the service
We give at least 30 days' notice of any price change for an ongoing subscription
Refunds and cancellation follow your agreement

8. Service Availability

We aim for reliable service but do not guarantee uninterrupted availability. Our services depend on third parties — including WhatsApp, Telegram, Twilio, Supabase, OpenAI and our hosting providers — and their outages or changes may affect us.

9. Limitation of Liability

To the extent permitted by Malaysian law:

The services are provided "as is"
ARA is not liable for indirect or consequential loss, including loss of profit, business or data, or for losses caused by AI errors, missed or late reminders, incorrect information or third-party outages
ARA's total liability for any claim is limited to the fees you paid ARA for the affected service in the 3 months before the claim arose

Nothing in these Terms excludes liability that cannot be excluded by law.

10. Suspension and Termination

We may suspend or terminate your access if you:

Breach these Terms or misuse the service
Cause harm to our systems or infrastructure
Carry out illegal activity

You may stop using a free service at any time. Paid services end according to your agreement's notice period. When a service ends, you may request an export of your data within 30 days, after which it is deleted — except where we must keep it by law or on a business client's instructions.

11. Intellectual Property

ARA's branding, workflows, AI prompts, system logic, software, dashboards, designs and website content belong to ARA Ai Solution. Using a service does not transfer ownership of them to you.

Your messages, documents and data remain yours (or your business client's).

12. Changes to These Terms

We may update these Terms from time to time. The date at the top shows the latest version. Active paying clients will be notified of material changes in advance.

13. Governing Law

These Terms are governed by the laws of Malaysia, and the courts of Kuala Lumpur have jurisdiction.
